“You” means the person using the website
By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. An acceptance email from us when your goods are shipped from our warehouse means we formally accept your order and are obliged to complete the contract.
By clicking the 'Next' button to submit your order on the checkout screen you are making an offer to purchase goods at the price stated subject to our terms and conditions. We will send you an email to acknowledge your order which will set out the goods you have ordered from us. This email is not an acceptance resulting in a binding contract. We will not accept your order for example if we do not have the goods in stock, your payment is not authorised, there is an error on our website regarding the price or other information about the goods or you have cancelled your order.
By using the website to buy goods online you are confirming that you are at least 18 years of age or that if under the age of 18 years that you are accessing the website with the consent of your parent or guardian.
All prices are shown in Pounds Sterling. Payment can only be accepted in Pounds Sterling. Prices include VAT. The price you pay is the price of the goods at the time you place your order even if the price of the goods has since the date of the order changed.
We accept on-line payment by all the major credit and debit cards, including Mastercard, Visa, American Express, Switch, Delta, and JCB. We also accept all credit and debit cards carrying the Mastercard or Visa logos.
Your credit card will not be debited until we are able to ship your goods to you.
We will send you an email as soon as your order has been shipped.
Whilst we try to effect delivery within 5 - 10 working days from receipt of your order, if an item is temporarily out of stock and shipping to you is anticipated to be longer, we will contact you by e-mail or telephone to arrange a new delivery date. If this cannot be agreed a refund can be given.
We cannot be held liable for any loss you may suffer as a result of late delivery or cancellation of your order. If you have any questions regarding delivery please e-mail us at firstname.lastname@example.org or telephone 01244 403939 quoting your order number.
We normally ship within 5 - 10 working days of your order being processed via Royal Mail Special Delivery (in the UK) or secure courier (international). No delivery charges are made for UK deliveries, we will advise you of any charges relating to International deliveries.
Special Delivery requires the package to be signed for and packages cannot be left without a signature. We will notify you by e-mail or telephone of the expected delivery date and we recommend you ensure someone is available to receive the package on that date.
We normally only deliver to your home address as confirmed by your credit card company. If you require delivery to another address (for example for a surprise present) then the alternative address must be registered with your credit card company as an alternative delivery address. All major credit card companies provide this facility, which can normally be arranged by telephone.
Alternatively, we can ship by a method of your choice (courier etc). Please e-mail or telephone us if you require any alternative arrangements. We will agree any charges with you as necessary.
For high value items we may wish to make individual arrangements for delivery. We will contact you either by e-mail or telephone in these circumstances.
All deliveries are fully insured by us at no charge to you from leaving our workshop until delivery to you. After receipt of the package you are responsible for any insurance requirements and we strongly recommend you make these arrangements in good time. If you require advice on insuring your jewellery please contact us.
If you have placed an order for a piece made to order which includes personalised or engraved items we will contact you to discuss delivery of these items before your order is processed, special return conditions apply to custom made pieces and you agree to a non refundable payment being processed upon us placing the order with our suppliers.
When you order from us via this website you are entitled to a cooling off period after dispatch, when you can return your goods without any penalty. Our cooling off period is 14 days which includes any statutory cooling off period.
The cooling off period starts the day the contract is agreed, namely when you receive the e mail from us stating that your order has been shipped, and ends 14 days after the day following delivery of the goods.
Unless we are at fault, certain items are excluded from the cooling off period guarantee. These include custom made pieces, personalised or engraved items and items of pierced jewellery including earrings or rings of the wrong size being ordered by you.
We want you to be fully satisfied with your purchase from Cheshires the Jewellers. However, if you are not fully satisfied with the goods you have purchased you may return these to us.
For a full refund, the goods must be returned undamaged and unused in the original boxes, and with all original certificates. There can be no scratches or marks on the item, and no sign of wear; the product cannot have been altered in any way. We cannot accept a return of goods that have been used, and all refunds are subject to inspection.
You must contact us within 14 days of receiving the goods, and follow this procedure:
1. You must contact the Sales Supervisor on 01244 403939, open on weekdays, ie, Monday to Friday 9:00 AM - 5:00 PM within 14 days of receipt of the goods.
2. The Sales Supervisor will authorise your return and issue a return authorisation number. Returns will not be accepted without this number.
3. All goods must be returned unworn, unaltered and undamaged.
4. All packages must be sent by REGISTERED MAIL or SECURE COURIER, and must be fully insured for the value of the goods. We offer insurance for returns - please ask the Sales Supervisor for a quotation when you call.
5. If the package is lost and not insured, you are responsible for the full cost of the goods.

7. All Original diamond certificates and a copy of the invoice must be included with the package in order for a full refund to be issued. Any package missing the certificate(s) will be charged a £100.00 additional fee per original certificate with no exceptions.
8. Cheshire's is not responsible for any packages it does not receive or returns not submitted in accordance with these guidelines.

Note: A return authorisation number is required for personal returns and arrangements made with the Sales Supervisor prior to any personal visit.
You must check the goods on delivery. If goods are delivered damaged or faulty you must inform us within 10 days of delivery and we will arrange collection and replacement at our expense. This clause also applies to custom made pieces, personalised or engraved items, items of pierced jewellery including earrings and rings. If you do not inform us within 10 days we shall have no liability for goods said to be faulty or damaged on delivery.
We endeavour to make our website as accurate as possible but certain features may look different depending on the functionality of the hardware and software used to view the site, colours may not be rendered correctly and product images may not show the actual size of items. Sizes, weights and measurements are approximate and are included for guidance only.
All personal details entered by our customers remain secure on our server until orders are downloaded and processed. We do not supply or sell customers details to any outside organisation. We will endeavor to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering.
We collect only the basic personal details required to process your order.
We will not release your name, address, e mail address or any other information about our customers to any outside party.
We will not trade, resell, sell or redistribute information that you provide to us, to any other companies, organisations or individuals.
All of our pages requesting personal information are completed using a secure link. This means that the information you send to us is encrypted in such a way that other Internet users are prevented from viewing your information. Our site utilises the maximum level of encryption allowed by your browser.
The latest versions of popular browsers display a locked padlock image, in the grey bar at the bottom of your browser screen, to indicate that you are browsing in a secure environment, and can be configured to warn the user if details are being sent over a non-secure link. Refer to your browser manufacturer for details of how this can be accomplished.
Credit Card purchases are processed through the Barclaycard ePDQ system. This provides a fully secure means of transferring your data and payment. To provide additional security the system undertakes the following checks:
The address you give us is compared to the Credit Card company’s records.
Using the Card Security Code (CSC) printed on the back of the card on the signature strip, we check the validity of the card by sending the CSC and card number to the card issuer for verification. The CSC is never stored with the transaction and is not printed on receipts. We can be sure through this process that the customer has the card in their possession.

These Terms and Conditions do not affect your statutory rights.
If any provision in these terms and conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed and rendered ineffective as far as possible without modifying the remaining provisions and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.
The web site, its contents, terms and conditions and contracts shall be governed by and construed in accordance with English Law and any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales.
